President Gül Gives DDK Instructions for Investigation on Five Topics

 

President Gül gave the State Supervisory Council (DDK), to be included in the 2014 working program, instructions regarding investigation, research and inspection on the following: institutional and regulational capacity of communications monitoring; the capability to combat corruption; analyses of city financing and construction projects; the regulation and implementation of career and professional applications and state secrets and degrees of confidentiality. 

EVALUATION OF INSTITUTIONAL AND REGULATIONAL ROLE OF COMMUNICATIONS MONITORING 

The first instruction which the President gave to DDK is to evaluate the institutional and regulational capacity of communications monitoring and to conduct the necessary research, investigation and inspection on specifying precautions so that the relevant practices can be as per the law. With this task, within a framework which enables the public administration to work effectively and according to the law and which provides for protection of individual rights and freedoms, the aims are to evaluate institutional and regulational capacity of communications monitoring; to provide for legal appropriateness of applications and procedures related to communications monitoring and its detection; to inspect the applications and standards for the use of encrypted communications devices in public administration, and to examine good international practices in this regard. 

EVALUATION OF CAPACITY TO COMBAT CORRUPTION 

Another instruction for investigation that President Gül gave DDK is the evaluation of capacity to combat corruption. With this task, the aim is to review the existing regulations and institutional structures pertaining to combating corruption, with the goal of examining such issues as weaknesses of the inspection structures and procedures in fighting corruption, within a framework which enables the public administration to work more effectively and appropriately, to prevent any approaches and implementations that undermine the culture of combating corruption and to consolidate legally appropriate behaviors. 

ANALYSIS OF CITY FINANCING AND EVALUATION OF CONSTRUCTION PROJECTS 

The third issue about which President Gül gave instructions for investigation to DDK is the analysis of city financing and the evaluation of construction projects. With this task, the aim is to examine in a way that includes such issues as city financing by providing fair distribution of the values, which the community creates and which emerge through construction and urbanization projects, and by preventing erosion of the integrity of public works, with the goal of providing for sustainable urban development; implementations that give rise to city financing issues; approaches to city financing issues that arise from modifications in construction projects; new approaches and methods toward new distribution of city and construction financing; and methods and instruments for community participation and inspection of modifications in city planning and construction. 

EVALUATION OF PROFESSIONAL CAREER APPLICATIONS 

President Gül’s instructions for investigation regarding professional career applications aim, within a framework of meeting the needs of the public administration effectively and productively as well as establishing equal opportunity, to examine the process of entrance and candidacy for professional careers (professions which require special competitive examinations such as judge, prosecutor, provincial governor, inspector, auditor and specialist); professional entrance requirements; written and verbal exam systems; security inquiries; in-service education; proficiency exams; ways and means of rights to appeal related to exams; and regulations and applications that disrupt equal opportunity and that lead to segregation. 

EVALUATION OF REGULATIONS AND APPLICATIONS PERTAINING TO STATE SECRETS AND DEGREES OF CONFIDENTIALITY 

The final instructions for investigation given by President Gül to DDK concern the evaluation of regulations and applications pertaining to state secrets and degrees of confidentiality. In this connection, within a framework of raising community oversight and participation and providing a democratic administration system and supervising state interests and adaptations, the aim is to provide for the examination of confidentiality in the public sector; analysis of the current situation in Turkey; the Right to Information Act; new approaches to identification and extent of state secrets; methods related to employing and protecting state secrets; institutional structure and regulational needs in this regard; applications directed toward degrees of confidentiality in public administration; and international good practices in this area.
